If so it will need to be listed by a Realtor, preferably one that has completed short sales in the past and uses a lawyer firm to negotiate. The bank will want to see it listed on the open market.
If it is listed then you would just make an offer and hope the listing agent is an agent like the one I just described or you may wait for quite a while only to find out you can't get the home you were hoping for.
